New Employment Law Affects Guard Companies

On January 1, 2019, a new law went into effect in California. Senate Bill 1343 requires all employers in the State of California with 5 or more employees to provide every employee with 1-hour of harassment and abusive conduct training, and 2 hours of training to every supervisor. The training compliance deadline is January 1, 2020.

"12950.1. (a) By January 1, 2020, an employer having five or more employees shall provide at least two hours of classroom or other effective interactive training and education regarding sexual harassment to all supervisory employees and at least one hour of classroom or other effective interactive training and education regarding sexual harassment to all nonsupervisory employees in California within six months of their assumption of a position."

Under the new law, even if the employee or supervisor received training in 2018, they must be retrained under the new guidelines in 2019. The training must be repeated every 2 years.

To make it more challenging, the training must be conducted by a "qualified provider." The average guard card trainer will not qualify as a trainer for the harassment and abusive conduct course under §11024. Sexual Harassment Training and Education. The trainer must have at least 2 years of experience as an employment law attorney, "Professors or instructors" in law schools, colleges or universities, "Human resource professionals," or "harassment prevention consultants."
